General audiences are gonna be confused as fuck when they try to google these two characters.

 

"What do you mean Shazam is Captain Marvel and Captain Marvel is Mar-vel and who the hell is Ms Marvel?"

Yes, and Marvel owns the trademark to publish a comic called "Captain Marvel" which is why the DC character is usually published under the title of "Shazam".  Even though the DC character can be referred to as Captain Marvel inside the book.

Captain marvel was originally a character owned by fawcett comics in the 1940's. They even had other characters titled 'marvels'. During that time this character rivalled even superman, outselling it even. 

 

But then DC sued fawcett comics regarding CM claiming it was too similar to Superman. FC stopped publishing the comics partly due to the lawsuit in early 1950's.  Marvel meanwhile started publishing their own Captain Marvel comics in late 60's. DC comics licensed the fawcett comics Captain Marvel in early 1970's, integrated them into their own comics and started publishing the comics. To differentiate DC captain marvel from that of Marvel comics version DC started calling it Shazam unofficially. DC finally officially changed the title to Shazam in 2011.

Confusing, I'm only vagely aware of the DC character, googling, the Marvel Capt Marvel is a woman ! That is a bit weird.

 

I can see that confusing a british audience.

DC doesn't even call him Captain Marvel anymore. He's Shazam now

I assume it's a trademark issue since Marvel has the Captain Marvel trademark so DC decided to avoid any legal issue and use Shazam which they can trademark for the character for merchandise and licensing.

lol, Marvel have had tons of Captain Marvels!

 

Their original and most famous one, Mar-Vell (a Kree soldier), never really got super popular until he died. (Because The Death of Captain Marvel was one of the best comic book stories of it's time.) Monica Rambeau and Genis-Vell were the main Captain Marvels after his death (though there were others, hello Noh-Varr), but then a few years ago Marvel came up with the idea to turn Carol Danvers (formerly Ms Marvel) into Captain Marvel, and it's an idea that stuck, thanks in part to a very heavy promotional push from the Marvel upper echelons. (Meanwhile, the new Ms Marvel is also another one of those rare ideas that has actually been a hit. Many comic folks would tell you they'd rather see a Kamala Khan movie than a Carol Danvers one.) 

 

Of course there have been many other Captain Marvel's throughout the years, be it Ultimate universe or whatever. Thanks to alternate universes and such, there have probably been dozens of Captain Marvels appearing in various Marvel comics.

 

The movie is going to star the current Carol Danvers version. (Who in the comics got her powers thanks to the original Mar-Vell, but in the movie will likely be a little different.)

 

Sound messy? The whole reason there have been so many Captain Marvels is of course, due to lawyers. The original "Shazam" Captain Marvel from the 1940's was of course published by Fawcett comics, but DC sued them for years and years until Fawcett didn't feel like paying the lawyers any more money and they just gave up publishing his comics. Fast forward to the 60's and Marvel comics became a thing and they wisely snatched up the trademark rights to the name Captain Marvel, since it was then unused. (Marvel wanted the name for obvious name-branding reasons.) They published a few Captain Marvel comics, but then in the 70's DC licensed the old Fawcett comic characters, so Marvel had to keep pushing out Captain Marvel comics so DC couldn't snag the name if the trademark lapsed. I believe in the 1980's DC actually bought the original Shazam Captain Marvel and the rest of the Fawcett characters, but ever since they've had to call his comics (and possible eventual movie) Shazam, because Marvel is obviously never going to let the title Captain Marvel go.

 

This is one of those reaping what you sow type of deals, as DC sued Fawcett and Captain Marvel all the way out of publication in the 40s and 50s, and now that they bought that character, they can't publish any books under his name thanks to that very lapse of publication that they caused. 

 

And let's not even talk about Marvelman.
